What is the difference between murder and manslaughter?
Murder requires an intent to kill (or in felony murder, intent to commit the underlying felony). Manslaughter is an unlawful killing without malice aforethought โ typically either voluntary manslaughter (in the heat of passion following adequate provocation) or involuntary manslaughter (unintentional killing through reckless conduct). The distinction determines whether someone faces 3 years or life in prison.
What is "felony murder"?
Felony murder holds all participants in a dangerous felony (robbery, rape, arson, burglary) responsible for any death that occurs during the commission of that felony โ even if they did not personally cause the death. A getaway driver can be convicted of felony murder if a co-conspirator kills someone during the robbery. It is one of the most expansive and controversial legal doctrines in American criminal law.
Can a homicide charge be reduced through a plea?
